About FitFeud

We at FitFeud.com are dedicated to protecting your privacy and handling any personal information we obtain from our registered users ("Registered Users") with care and respect. The Privacy Policy (the "Policy") for our web site (the "Site") was developed as an extension of our commitment to combine the highest-quality service with the highest level of integrity in dealing with our customers and partners. The Policy is designed to answer your questions regarding our privacy policy and principles. This statement will be continuously assessed against new technologies, business practices and our customers' needs. To enrich our users' experience, we request and display some personal information to other members and visitors. FitFeud users can change their profile information at any time and can control who can see their fitness results.

Information Collected

FitFeud collects user submitted information such as nickname, email address, weight, height, and time zone to authenticate users and to assist users relating to the FitFeud service. FitFeud also collects other profile data including but not limited to: personal interests, geographical location, gender, total competitions, and age in order to assist our members find and communicate with each other.

FitFeud is the sole owner of the information collected on www.fitfeud.com ("FitFeud.com"). FitFeud is a licensee of all user-provided content on FitFeud.com. FitFeud is the sole owner of the compilation of content that comprises FitFeud.com.

  • Personal Information. We will not collect any personally-identifiable information about you (e.g., your name, address, telephone number, email address, height, age, weight, time zone preference, and credit card information) through the Site unless you have provided it to us voluntarily (e.g., Site registration, orders of goods and services).
  • Web Site Use Information. In some cases, we may automatically (i.e., not via registration) collect technical information when you connect to our Site that is not personally-identifiable. Examples of this type of information include the type of Internet browser you are using, the type of computer operation system you are using and the domain name of the web site from which you linked to our site. We do not claim ownership of User Content; provided, however, you hereby grant us a world-wide, royalty-free, non-exclusive, perpetual, irrevocable, and fully sub-licensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display your User Content and to incorporate User Content in other works in any form, media, or technology now known or later developed. You acknowledge and agree that User Content will be publicly available and that, as a result, you may receive unsolicited messages from other parties. We cannot ensure the security of any information you choose to make public in a chat room, forum, or message board. Also, we cannot ensure that parties who have access to such publicly available information will respect your privacy.   • Email Communications. If you open emails from us, we may receive a confirmation noting you opened the email, if your computer supports such capabilities. We also may keep track of what emails we send you and what emails you may be receiving from our affiliates and partners. Additionally, we keep a record of what communications you have opted to receive or not to receive.

General Information

The Site is a general audience web site. We do not currently collect or maintain any personal information from children under the age of thirteen. If in the future, we collect personally identifiable information from children, we will do so in compliance with the Children's Online Privacy Protection Act of 1998 (15 U.S.C. S 6501 et seq.) including, without limitation, obtaining necessary parental consent.

As applicable, the information you provide to us may be used to:

  • contact you relating to your competition status;
  • confirm or fulfill an order you have made;

  • contact you with regard to a sweepstakes, contest or promotion in which you have participated or to inform you of a prize you have won;

Notwithstanding that your mobile number may be listed on state and/or federal do-not-call registries, we retain the right to contact you via text-message based marketing. In addition, by registering and/or using the Site, you agree that such act constitutes an inquiry and/or application for purposes of the Amended Telemarketing Sales Rule (16 CFR S310 et seq.), as amended from time to time (the "Rule"). Notwithstanding that your telephone number may be listed at the Federal Trade Commission's Do-Not-Call List, we retain the right to contact you via telemarketing in accordance with the Rule.

Correcting/Updating or Removing Information

FitFeud users may modify or remove any of their personal information at any time by logging into their account and accessing features such as Edit Profile and Account Settings. Additionally, to revise or remove personal information you submitted on the Site during registration, the purchase of a product or service, or elsewhere you may contact us at support@fitfeud.com to make such changes, you expressly authorize us to access your data for purposes of completing your requested modifications and/or deletions. If you would like us to no longer use your personal information, please e-mail us at support@fitfeud.com with your request.

Cookies

FitFeud uses cookies to store visitors' preferences and to record session information, for purposes including ensuring that visitors are not repeatedly offered the same advertisements and to customize newsletter, advertising, and Web page content based on browser type and user profile information. We do not link the information we store in cookies to any personally identifiable information you submit while on our site. You may be able to configure your browser to accept or reject all or some cookies, or notify you when a cookie is set -- each browser is different, so check the "Help" menu of your browser to learn how to change your cookie preferences -- however, you must enable cookies from FitFeud in order to use most functions on the site.

Links

FitFeud contains links to sites. Our site is not responsible for the privacy policies and/or practices on other sites. When linking to another site a user should read the privacy policy stated on that site.

Security

FitFeud takes precautions to insure that member account information is kept private. We use reasonable measures to protect member information that is stored within our database, and we restrict access to member information to those employees who need access to perform their job functions, such as our customer service personnel and technical staff. Please note that we cannot guarantee the security of member account information. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of member information at any time.

Changes in Our Privacy Policy

From time to time we may make changes to our privacy policy If we make changes, we will post them on our site to make users aware of what the changes are so users will always be aware of what information we collect, how we use it, and when we may disclose it. A User is bound by any minor changes to the policy when she or he uses the site after those changes have been posted If, however, we are going to use users' personally identifiable information in a manner materially different from that stated at the time of collection we will notify by posting a notice on our Web site for 30 days.
